Default I can't afford these lenses

I don't know where else to post this..but my doctor ordered me contact lenses that are going to cost me $260.00. So I went to Sam
s club (for those of you who don't know it's a big warehouse grocery store) and they said they can get me the same contact lenses for a hundred dollars less! So I was super excited to do this but my doctor said I have to apy for the ones I ordered and there is nothing he can do. He also won't give me my perscription so I can order the cheaper ones. I just wanted to know if I HAVE to pay for the ones I ordered or if they can just send them back. Everyone else says they were made just for me so I HAVE to pay for them..and I just can't afford it. What should I do?

Hello lgvolcom. Welcome to Lens 101.

Someone will have to back me up on this one, but I'm pretty sure that your eye doctor must, by law, give you your prescription so you have the option to shop someplace else.
It's true that the contact lenses from your doctor's office are made just for you, but so would the lenses you buy someplace else. That's why you need the prescription.

Before you buy your sunglasses at Sam's Club check out the sponsor of Lens 101, lens.com. Just click on the big red bar right below these words. They have Air Optix Aqua advertised for $28.50 a box.

Your doctor is not required to provide a copy of your prescription if you owe him money.

Sounds like that's the case.

It sounds like you ordered a one year supply. Why did you order the lenses from your doctor if you can't afford it? Why didn't you order a 6 month supply?

That's probably true. Did you wear any of the contacts you ordered from your eye doctor, lgvolcom? If you did, you will probably be stuck with them. You may be able to make a deal with your eye doctor to only pay for the box you opened, and then get a prescription for the remainder of your order. I don't see why you can't return unopened boxes for a refund. Did you get a year's supply, or just a month's?

In the end, you'll probably have to call it "experience" and try not to let it happen again.

I think yournamehere is right. Have you done anything to get your money back since we heard from you last?

No word yet. Either lgvolcom is still trying to get a refund, or has given up on getting the money back. That's my guess.

Do you really need special order contacts or are you getting snowed? Not knowing your Rx I can't tell. Sams Club (Walmart) is no bargain for contacts. If they have your Rx, I doubt they are really special order. YES your doctor does have to give you a written prescription. Complain to your state health department, who licenses him, if they refuse. As for the lenses, I suggest your doctor wear them.

You say that he ordered them. You may have a case if you never actually gave him instructions to order the lenses for you. If he said "I'm going to get you those lenses" and you said "okay" then you'll probably wind up paying for them. I suppose it's probably too late to cancel the order now. Sorry.
If the lenses are still unopened you may be able to sell them and get enough money to buy your contacts on line. You have to be careful where you sell them though. Some websites don't allow you to sell personal items like contact lenses. Check the rules before you attempt to sell.

Yeah, tell that to your optometrist when he or she refuses to give you your prescription so you can find some more comfortable lenses somewhere else.

Absolutely wrong. Federal law requires all ECP's to provide a prescription, and makes no mention of credit holds. I would suggest an on line order for contacts to the supplier of his choice. The doctor's office is only asked if a certain lens was prescribed, not what the customer's balance is. The seller can ship any contact order that is not confirmed within 8 business hours. If the doctor misstates the facts, and claims he never prescribed a given lens, this would be fraud, and medical malfeasance.

That's very interesting, mgash. Do you know of a website that explains--simply--the legal obligations of an eye care professional?

You are partially correct. Yes, a ECP must provide a prescription to the patient, even if the patient does not ask for it, free of additional charges. However, the hang-up is the contact lenses our original poster had already ordered from the ECP but is now deciding that she doesn't want them or can't afford them. I can't post the link to the Federal contact lens Rule, I apparently haven't posted enough to include a link in my reply....

Per Federal Regs, a "Prescribers may require a patient to pay for the eye exam, fitting and evaluation before giving the patient a copy of the contact lens prescription, but only if the prescriber also requires immediate payment from patients whose eye exams reveal no need for glasses, contact lenses, or other corrective eye care products. Proof of valid insurance coverage counts as payment for purposes of this requirement."

Whether or not this also applies to paying for lenses that you ordered, I don't 100% for sure know. I know my ECP had me pay for the lenses when he ordered them for me. I didn't know anything about contacts so I had him order them, only to find out later that I could have gotten them cheaper. Lesson learned.

As for lgvolcom, don't know what he/she ended up doing but I'm pretty well sure she had to take the lenses as most ECP's will only take lenses back in unopened packages IF the prescription changes, not because the patient decides he/she can't afford them. Since the post is almost 2 years old it's anyone's guess as to what happened to lgvolcom........ He/She left us, I guess....

Thanks for taking the time to research the answer and then explain it to us, cxwatts. I hope that lgvolcom was able to use the information given, even if we don't hear back right away.

Yeah, I feel bad when we lose touch with someone. Especially when they come with an unusual question, and after they wait a while with no response, I guess the give up and move on. I usually stop by here every once in a while and see what's new. Then I respond to the answers I get to my questions. I feel more a part of things that way.
